Stairs kill. That is not hyperbole — falls are the leading cause of home injury deaths for adults over 65, and inconsistent riser height is one of the top contributors. That is why the stair riser height code in the International Residential Code is so specific: 7.75 inches maximum, 4 inches minimum, and no single riser can vary more than 3/8 inch from any other in the same flight. Get any of those wrong and your inspector will redline the project — or worse, someone gets hurt.

The International Residential Code (IRC), which most US jurisdictions adopt with minor tweaks, governs residential stair geometry in Section R311.7. The core numbers for a typical one- or two-family dwelling:

- Minimum riser height: 4 inches
- Minimum tread depth: 10 inches (measured nose to nose)
- Maximum variation between risers or treads in a flight: 3/8 inch (0.375″)
- Minimum headroom: 6 feet 8 inches above the nosing line
- Minimum stair width: 36 inches above handrail height
A typical residential flight in the US ends up at 7 to 7-5/8 inches per riser with 10 to 11-inch treads. Commercial stairs under the IBC are stricter — 7 inches max riser, 11 inches minimum tread — but that rarely applies to homes.
Why the 3/8 Inch Consistency Rule Matters
Your brain memorizes the rhythm of a staircase in the first two or three steps. After that, your feet lift to whatever height they expect, not what is actually there. A single riser that is 1/2 inch taller than the rest will trip an adult almost every time, even in broad daylight. That is why code limits variation to 3/8 inch — the threshold where humans reliably catch themselves.
The rule applies within a single flight. If you have a landing breaking the run, the top flight and bottom flight are measured independently — but each internally must hold the 3/8 inch tolerance.
How to Calculate Riser Height
The math is simple. Measure total vertical rise from finished floor to finished floor (not subfloor to subfloor — flooring thickness matters). Divide by a target riser height around 7 inches and round to a whole number for the riser count. Then divide rise by that whole number to get exact riser height.
Example: 108 inch total rise. 108 / 7 = 15.4. Round to 15 risers. 108 / 15 = 7.2 inch risers. That is well within code.
For 14 risers instead: 108 / 14 = 7.71 inches — still under 7.75 but cutting it close. Always leave yourself 1/16 to 1/8 inch of headroom for finish flooring added later.
Tread Depth Works Hand in Hand
Riser height alone does not make a safe stair — you also need the tread deep enough to plant a foot securely. IRC requires a 10-inch minimum tread depth, measured from nosing to nosing (the leading edge of one tread to the leading edge of the next). A 3/4 to 1-1/4 inch nosing overhang is required on any stair without a closed riser, helping cup the foot on the descent.
The old rule of thumb — riser plus tread should equal 17 to 18 inches — still produces comfortable stairs. A 7.5-inch riser with a 10.5-inch tread (18 total) feels natural. A 6-inch riser with a 14-inch tread makes a gentler but stretchy stair for formal entries.
Basement and Attic Stair Exceptions
Older homes often have steeper basement stairs built before code, and most jurisdictions grandfather those unless you tear them out. If you are rebuilding, though, the code applies fresh — 7.75 max riser, 10 min tread, even on a basement flight. You cannot squeeze in a 9-inch riser just because the space is tight.
Pull-down attic ladders, spiral staircases, and alternating-tread devices have their own separate IRC sections with looser rules. They are only allowed as secondary means of access in limited situations.
Handrails and Guardrails
Any stair with four or more risers requires a handrail on at least one side, mounted 34-38 inches above the nosing line. The grip must fit inside the rule of 1-1/4 to 2 inch diameter for round profiles, or a specific dimensional envelope for non-circular shapes. Open sides of stairs more than 30 inches above the floor below need guardrails at least 34 inches tall with spindles no more than 4 inches apart (the sphere test).
Common Code Violations Inspectors Find
- Top or bottom riser off by more than 3/8 inch — often because flooring thickness changes were ignored
- Missing nosing on open-riser stairs with treads under 11 inches deep
- Handrail too low or too high — the 34-38 inch window is measured at the nosing
- Graspable handrail profile wrong — oversized decorative newel caps don’t count as grippable
- Guardrail spacing failing the 4-inch sphere test, especially on horizontal cable rails
When You Need a Variance or Permit
Any new staircase in new construction, an addition, or a major remodel requires a permit and inspection in most jurisdictions. Replacing an existing stair in place with identical geometry is often classified as repair and may skip permitting — but check with your local building department, because rules vary.
If your existing stair violates current code (say, it has 8.5 inch risers) and you are just replacing treads and risers, you can usually match the existing dimensions under grandfathering. But if you rip it out entirely and start over, you must meet current code even in an existing footprint.
Practical Pro Tips
Use a framing square and a stair gauge set when marking stringers — it keeps every riser identical. Cut the top riser short by the thickness of the finish tread material so the top step lands flush with the upper floor. Dry-fit the entire flight before fastening anything, and check every riser with a tape before you pull the trigger on the nail gun.
